          EU Toy Regulation (EU) 2019/1929 begins to comprehensively restrict formaldehyde

           

          On November 20, 2019, the Official Journal of the European Union released Directive 2019/1929, revising Appendix C of Annex II to the EU Toy Safety Directive 2009/48/EC, which comprehensively restricts formaldehyde in toy products. The latest limit requirements for toys suitable for children under 36 months old or can be placed in the mouth are shown in the table below:

          Background

           

          According to the requirements of 2009/48/EC, carcinogenic, teratogenic or reproductive toxic substances (CMRs) in the EU CLP Regulation (EC) No 1272/2008 should not be used in toys. Formaldehyde (CAS No. 50-00-0) is classified as a carcinogen class 1B, but is not listed in Appendix C of Annex II of the Toy Regulations. According to Part III of 2009/48/EC, formaldehyde can reach a concentration of 1000 mg/kg in toy products. However, according to WHO data, such limits cannot protect the health and safety of children.

           

          In fact, as early as December 18, 2018, the European Commission notified the World Trade Organization (WTO) of a draft directive that sets specific limits for formaldehyde in toys or other toy materials used by children under 36 months of age. This amendment will be based on Appendix C of Annex II to the Toy Safety Directive 2009/48/EC. The period for soliciting opinions is until February 16, 2019. Subsequently, no formal directive was issued until the release of the EU Directive 2019/1929.

           

          The European Union has issued Directive (EU) 2019/1922 revising the aluminum limit values in the Toy Safety Directive

           

          On November 19, 2019, the European Union issued Directive (EU) 2019/1922, revising the limit values for aluminum in Appendix II of the EU Toy Directive (2009/48/EC). Revised as follows:

          EU releases updated toy safety standards EN 71-3:2019+A2:2024

           

          On October 31, 2024, the European Committee for Standardization (CEN) approved a revised version of the toy safety standard EN 71-3: EN 71-3:2019+A2:2024 "Toy Safety - Part 3: Migration of Specific Elements", followed by the official release of the standard on December 4, 2024.

           

          According to CEN information, it is expected that this standard will be approved by the European Commission no later than June 30, 2025, and conflicting national standards (EN 71-3:2019+A1:2021/prA2, and EN 71-3:2019+A1:2021) will be replaced simultaneously; At that time, the standard EN 71-3:2019+A2:2024 will be given the status of a mandatory standard at the level of EU member states and will be published in the official EU gazette, becoming a coordinated standard for the Toy Safety Directive 2009/48/EC.
